Older people in the UK are being urged to check how a hospital stay could affect their benefit payments, after renewed warnings about a little-known Department for Work and Pensions rule. While the State Pension itself is protected, several related benefits can be reduced or stopped altogether once someone has been in hospital for more than 28 days.
The rule is not new, but charities and financial advisers say many pensioners only discover it after payments change, often during an already stressful period of ill health.
Protection
The State Pension is not affected by hospital stays, regardless of how long someone remains in hospital. This applies to both the older basic State Pension and the newer State Pension.
According to Pension Bee, entitlement to the State Pension continues as normal whether someone is hospitalised for days, weeks, or months. Payments are not reduced and do not stop under the 28-day rule.
Limits
Other benefits commonly received by pensioners are treated differently. Once a hospital stay reaches 28 days, several payments may be suspended or reduced.
Benefits affected can include:
- Attendance Allowance
- Pension Credit
- Disability Living Allowance (DLA)
- Personal Independence Payment (PIP)
- Adult Disability Payment (ADP)
- Pension Age Disability Payment (PADP)
Independent Age says pensioners must notify the relevant benefit office if they spend even one night in an NHS hospital. Failing to do so could result in overpayments, which would later need to be repaid.
Counting
The way hospital days are counted can catch people out. The day after admission is counted as day one, while the day before discharge is the final day.
If someone leaves hospital but is readmitted within 28 days, those hospital stays are added together. If the combined total exceeds 28 days, entitlement to certain benefits can be paused until the person returns home.
Different rules may apply if someone receiving PIP moves directly from hospital into a care home. In those cases, claimants are advised to contact the PIP enquiry line for guidance.
Disability
For disability-related benefits such as Attendance Allowance, PIP, and DLA, payments usually stop once the 28-day limit is reached. Pensioners are expected to contact the relevant helpline both when they are admitted and when they are discharged.
Those with a Motability lease for a car, scooter, or powered wheelchair should also notify Motability if they remain in hospital beyond 28 days. The organisation can discuss temporary arrangements depending on individual circumstances.
Credit
Pension Credit can also be affected by hospital stays, particularly where other benefits are suspended. Pension Credit is designed to top up weekly income for people of State Pension age whose earnings fall below a set level, currently £238 per week.
For those on the older basic State Pension, which tops out at £184.90 per week, Pension Credit can make up a significant share of total income. It can also support recipients of the new State Pension who do not receive the full £241.30 weekly amount due to gaps in their National Insurance record.
Pension Bee explains that Pension Credit includes two parts: Guarantee Credit and Savings Credit. Changes to disability benefits during a hospital stay can reduce or suspend Pension Credit entitlement.
Couples
Age UK has raised particular concerns about couples, especially where one partner has not yet reached State Pension age. In some cases, Pension Credit entitlement may not be automatically reinstated after a hospital stay ends.
The charity also warns that short-term transfers from hospital into care homes or community hospitals for free intermediate care can still count toward the 28-day limit.
Housing
Housing Benefit is treated differently. Claimants can continue receiving Housing Benefit during a hospital stay of up to one year, as long as the property has not been rented out or sublet during that time.
Reporting
The government says pensioners must inform the relevant benefits office immediately if they are admitted to hospital for one night or longer. They must also report their discharge.
Those receiving the State Pension, Pension Credit, or Attendance Allowance should contact the Pension Service helpline. Claimants will need the reference number shown on their benefit award letter.
Charities stress that timely reporting can prevent overpayments, suspended claims, and unexpected reductions once someone returns home.
